Definitions

Artist:
The individual providing the Commission. “Artist”, “Inklypuff” “myself”, and “I” are used interchangeably.Client:
The individual purchasing the Commission. Also referred to as the "Commissioner."Commission:
The service which is being provided.Order Form:
The digital document that details and communicates the Client’s information, desired commission request, subject references, and —if applicable—, confidentiality preferences and/or desired Usage License to the Artist. "Request Form", and "Commission Request" are used interchangably.Commission Agreement:
The discussion, documented via email (or any other communication service such as Discord or Twitter direct messages), in which —following review of the Client’s Request Form,— the Artist & the Client agree to the proposed subject matter & type of Commission to be created, the Commission price, the estimated time in which the Artist is expected to commence the Start of Work, and —if applicable, — estimated Turn Around Time, desired Usage License, early termination circumstances, whether or not the Client wishes for the Commission work process to be Broadcasted by the Artist, and/or whether or not the Commission can be immediately displayed on the Artist’s portfolio / Websites / Social Media.This Commission Agreement shall remain on record with the Artist, along with any other documents related to the commission, for at least two years. The Commission Agreement will usually conclude with:“This Agreement is the final, complete and exclusive agreement of the parties with respect to the subject matter hereof and supersedes and merges all prior communications between the Artist/Client with respect to such matters. No modification of, or amendment to this Agreement — or any other waiver of any rights under this agreement, —will be effective unless in writing and signed by the Artist.”Start of Work:
The point in time by which the Artist begins sketching the first draft of the Commission Request. Start of Work will only commence after the Client & Artist have finalized the Commission Agreement and the first invoice has been paid.Social Media:
Online websites where the Commission may be displayed. (e.g. Twitter, Instagram, TikTok, YouTube, Twitch, Tumblr, etc.)“Social Media” does not include websites that display hateful or racist imagery, illegal activities, or sites known to display, reproduce, and/or sell works without crediting the Artist.Usage License:
The licensing agreement granted to the Client by the Artist following the Delivery of the Commission. The Usage License permits the Client the right to use the work as specified by the Licensing Tier the Client selected. Any given Usage License is revocable by the Artist, with or without cause.Licensing Tier:
The level of Usage License the Artist has made available for the Client to select based on their intended desired use of the Commission; Personal Use, Commercial A Use, and Commercial B Use.“Personal Use” refers to the use of the Commission for non-commercial, non-advertising purposes, such as desktop wallpaper, personal items, and or social media banners, profile pictures, and posts."Commercial A Use" refers to the use of the Commission for purposes suitable for a content creator. The Commission may be used in social media posts, videos, and streams, without the intent to generate profit of the design or promote a product. This license does not include the right to sell physical or digital merchandise featuring the Commission, nor may it be used it in advertisements for products."Commercial B Use" refers to using the commissioned artwork to promote a brand or product, as well as to generate revenue through digital or physical goods. This includes featuring the artwork on a website, business cards, or as a book cover, packaging design, or video game character asset. Commercial B Use also includes the permissions granted in Commercial A Use.Delivery:
The process in which the Artist submits the final copy of the Commission to the Client.

For Commissions under Personal and Commercial A Usage Licenses, the Client must give tagged or linked credit to the Artist for the Commission when displayed or used on social media.For Commissions under a Commercial B Usage License, proper accreditation is requested whenever reasonably applicable.

Any use for the commission is subject to change
as outlined by the Commission Agreement.

You may not do the following:

VIOLATION OF THIS POLICY IS CONSIDERED A BREACH OF CONTRACT.

Payment

Please note:

I do NOT accept funds from other sources as valid forms of payment.
(I.e. Twitch Channel Sub, Twitch Bits, Tip via my Stream Elements’ page, etc.)
I bear no responsibility or obligation to refund such unsolicited funds

DISCLAIMER:

The artist is not responsible for saving or backing up the Commission after delivery. It is the Client's responsibility to download & backup the Commission files.
